Service Agreement

All projects begin with a formal agreement outlining specific deliverables, timelines, and payment terms. This agreement, along with these Terms, constitutes our complete understanding regarding the services to be provided.

Client Responsibilities

As a client, you agree to:

• Provide timely feedback, content, and approvals necessary to complete your project

• Review and approve deliverables within the timeframes specified in our agreement

• Provide accurate information regarding your business and project requirements

• Obtain proper licenses for any third-party materials (images, fonts, etc.) you provide

• Comply with all applicable laws and regulations regarding your website content

Intellectual Property

Your Content

You retain ownership of all content you provide (text, images, logos, etc.). By providing this content, you grant me a license to use it for the purpose of creating and maintaining your website.

My Work Product

Upon full payment, you receive ownership rights to the final website design and development as delivered. I retain ownership of:

• Pre-existing materials, frameworks, and tools used in creating your website

• Unused concepts and designs presented during the project

• General knowledge, techniques, and skills developed during our work together

Portfolio Rights

Unless otherwise agreed, I reserve the right to display your completed project in my portfolio and marketing materials as an example of my work.

Intellectual Property Notice

All text, photographs, graphics, and other materials on this website are subject to my copyrights and other intellectual property rights and are protected by United States Copyright Laws. Website materials may not be copied for any reason, including your personal use, commercial use, or distribution, nor may these materials be modified or reposted to other sites, without my prior express written permission. I reserve the right to take legal action against unauthorized use of my intellectual property, including asking for financial penalties (damages) and/or an injunction forcing You to stop using my intellectual property immediately.

Your Communications

Project fees are outlined in our service agreement. I require an initial deposit before beginning work, with remaining payments scheduled as outlined in our agreement.

Late Payments

Late payments may result in:

• Suspension of ongoing work

• Late fees

• Retention of intellectual property rights until full payment is received

Cancellation Policy

If you cancel a project after work has begun:

• The initial deposit is non-refundable

• You will be invoiced for all work completed up to the cancellation date

• Cancellation must be submitted in writing

Limitation of Liability

Warranties

I warrant that my services will be performed in a professional manner consistent with industry standards. I do not guarantee specific business outcomes or results from my services.

Limitation of Damages

My liability is limited to the total amount paid for the specific services giving rise to a claim. I am not liable for indirect, consequential, or special damages.

Website Functionality

While I strive to create websites that function across major browsers and devices, I cannot guarantee perfect functionality across all possible combinations of browsers, devices, and settings.

Disclaimers

My website and related materials are provided for educational and informational use only. A project is considered complete when:

• All deliverables outlined in our agreement have been provided

• The agreed-upon revision rounds have been completed

• The website has been approved and launched, or has been delivered in the agreed-upon format

Website Maintenance and Support

Post-Launch Support

Unless specified in our agreement, website maintenance and updates after project completion may require additional fees.

Website Hosting

I am not responsible for website downtime, performance issues, or security breaches related to your choice of hosting provider.

Termination
